Privacy Policy
My Accident Payout (“we”, “us”) operates my-accident-payout.com, a free quiz that helps accident victims estimate what their car accident claim may be worth. This policy explains what information we collect when you use the site, how we use it, who we share or sell it to, and the choices you have. Please read it — this is a lead-generation service, and if you submit the form, your information will be shared with businesses that pay to receive it.
What We Collect
- Contact information — your first and last name, email address, and phone number when you submit the form.
- Accident and quiz answers — the answers you give in the claim-check quiz, such as accident type, who was injured, medical treatment received, fault, whether a police report was filed, the state where the accident happened, and when it happened.
- Device and usage data — IP address, browser and device information, pages viewed, quiz steps completed, and referring URLs (including ad-click identifiers in the address bar).
- Cookies and advertising pixels — we use cookies and similar technologies, including the Meta (Facebook) Pixel and the Meta Conversions API, to measure advertising and understand how visitors use the site. These tools may send Meta information about your visit, including quiz progress and hashed contact details.
- Consent certification — when you submit the form, we use consent-verification services such as ActiveProspect TrustedForm and/or Jornaya to record proof of your consent, including a snapshot of the page and form as you saw it.
How We Use Your Information
- To evaluate your inquiry — your quiz answers determine whether your situation may qualify and help estimate what your claim may be worth.
- To connect you with participating claim specialists and law firms who pay for inquiries. This is the core of our service and how we make money: businesses in our network pay marketing fees to receive inquiries like yours so they can contact you about your potential claim.
- To improve the service — we analyze usage data to fix problems and make the quiz clearer and faster.
- Advertising measurement — we use pixel and conversion data to measure which ads work, so we can spend advertising budgets on ads that reach people who actually need help.
Who We Share It With
- Marketing partners and inquiry buyers — the participating claim specialists and law firms described above and listed on our Marketing Partners page, so they can contact you about your potential claim.
- Service providers — companies that help us run the site, such as hosting, SMS verification, call routing, analytics, advertising platforms, and consent-certification providers. They may only use your information to provide services to us.
- Legal — when required by law, subpoena, or court order, or to protect our rights, users, or others.
We May Sell or Share Your Inquiry
When you submit the form, we may sell or share your inquiry — your contact information and accident details — with participating claim specialists and law firms, as the terms “sell” and “share” are defined by the California Consumer Privacy Act (CCPA/CPRA) and similar state privacy laws. We do this so those businesses can contact you about your potential claim; that is the service you are requesting when you submit the form. You can opt out at any time (see below).
Do Not Sell or Share My Personal Information
To opt out of the sale or sharing of your personal information, email privacy@my-accident-payout.com with the subject line “Do Not Sell or Share” and include the name, email address, and phone number you submitted so we can locate your record. We will honor verified opt-out requests within 15 business days. Opting out stops future sales and sharing by us; partners who already received your inquiry may continue to contact you until you tell them to stop (reply STOP to any text, or ask to be removed on any call).
Your Privacy Rights
Depending on where you live — including under the CCPA/CPRA (California), the Texas Data Privacy and Security Act, the Florida Digital Bill of Rights, and similar laws in other states — you may have the right to:
- Know and access the personal information we hold about you.
- Correct inaccurate personal information.
- Delete your personal information.
- Opt out of the sale or sharing of your personal information.
- Not be discriminated against for exercising these rights.
To exercise any of these rights, email privacy@my-accident-payout.com. We will verify your request using the contact details you submitted and respond within the time required by your state’s law. You may also use an authorized agent where your state permits it.
How Long We Keep It
We keep inquiry records, including consent certificates, for as long as needed to run the service and to meet legal obligations — consent records are typically retained for several years because telemarketing laws require proof of consent. We delete or de-identify data when it is no longer needed, or sooner if you make a verified deletion request.
Security
We use reasonable administrative and technical safeguards — including encryption in transit and access controls — to protect your information. No website can guarantee perfect security, so please only submit the information the form asks for.
Children
This service is for adults. It is not directed to anyone under 18, and we do not knowingly collect information from anyone under 18. If you believe a minor has submitted information, email privacy@my-accident-payout.com and we will delete it.
Changes to This Policy
We may update this policy from time to time. The “Last updated” date at the top shows the current version. Material changes will be posted on this page before they take effect.
